Labor Law

Our firm provides specialized services with a focus on preventive analysis and strategic guidance, aimed at avoiding litigation and ensuring full compliance with labour laws. When legal action becomes unavoidable, we are prepared to vigorously defend our clients’ interests—whether employers or employees—ensuring their rights are upheld and protected at every stage of the process.

We provide Legal Support in Key Employment Matters:

  • Overtime Pay: The worker has the right to receive additional remuneration for hours worked beyond regular working hours, usually with a 50% increase on top of the normal hour value, which can reach 100% in special situations.

  • Termination Rights: upon termination of an employment contract, employees are entitled to severance pay, including outstanding salary, proportional holiday pay, a prorated 13th salary, and, where applicable, the FGTS (Severance Guarantee Fund) fine.

  • Hazard Pay and Unhealthy Work Conditions: Employees exposed to hazardous or unhealthy working environments are entitled to additional compensation, typically ranging from 10% to 40% of their base salary, depending on the level of risk involved.

  • Paid Vacation: Every employee is entitled to 30 days of paid vacation for every 12 months of work, with an additional one-third of their regular salary paid as a vacation bonus.

  • FGTS (Pension Fund for Work Experience): The FGTS is an account linked to the employment contract, where the employer must deposit monthly 8% of the employee's salary, which can be withdrawn in situations such as unjustified termination or even for the purchase of real estate.

  • Employees are entitled to the benefits mentioned above, along with others arising from the employment relationship. Our specialized team is prepared to perform detailed calculations and file labor claims to ensure all rights are duly upheld.

  • Employers, in turn, can count on our support for a thorough review of previously paid contributions and an assessment of whether any additional employee entitlements apply, helping to prevent unjust or excessive claims.
